The Lessor rents to the Renter a passenger car ("the Rental Car").
The Renter accepts the condition of the Rental Car as it is at the moment the rental agreement is signed.
The Rental Car is intended exclusively for use as a passenger car by holders of a valid driving licence.
Driving is expressly not permitted in the following areas: unpaved roads / Vlakte van Hato / Barber / Christoffelpark / St. Jorisbaai.
The rental is granted for the period described in the contract.
The Renter is not entitled to terminate the rental agreement free of charge.
The parties agree a net base rental price as described in the contract.
The full rental amount is due on the day the car is received. No deposit is charged.
If damage is found, the Renter's costs depend on the insurance chosen. If the Renter chose the all-risk insurance in writing on the rental agreement, the excess (deductible) is €500.
Without all-risk insurance, liability is unlimited up to the current market value of the car, plus the Lessor's loss of rental income up to a maximum of 30 rental days. With the excess buy-off option, no costs are charged for identified damage.
All costs resulting from mechanical failure are borne by the Lessor, provided they are not due to negligence or misuse by the driver.
Other costs — such as tyres, glass breakage, bulbs, loss of parts and bodywork damage — are borne by the Renter.
The Renter remains fully liable at all times in cases of gross fault, negligence, or driving under the influence of alcohol or other substances that impair driving ability.
The Renter must report any damage to the Lessor immediately.
If damage only becomes known on the last rental day, the Lessor may charge for the resulting inability to rent out the car ("loss of rental income").
The Lessor will do their utmost to keep the Rental Car in good condition and to carry out (or arrange) all repair and wear-related work as quickly as possible.
The Renter will treat the Rental Car with care and use it as described in Article 2.
The Renter must return the Rental Car when this rental agreement ends, for whatever reason.
If the Renter fails to do so, they will pay €100 for each subsequent day.
If the Renter returns the car before the agreed end date, there is no right to a refund.
The Rental Car must be returned in the condition it was in when the rental agreement was entered into.
The Rental Car is always delivered to the Renter with a full tank and must be returned with a full tank.
The rental agreement is automatically dissolved in the event of loss or destruction of the Rental Car. In that case, the Renter has no right to a refund of the rental amount.
The rental agreement is dissolved by operation of law if either party fails to fulfil its obligations under the agreement.
The Renter may not transfer the contract to third parties.
The Rental Car may not be sublet, in whole or in part, without the Lessor's permission.
Smoking in the Rental Car is not permitted.
Transporting animals in the Rental Car is not permitted.
The Renter is responsible for replacing the tyre in the event of a flat tyre.
The Renter may not continue driving when a warning light is on.
The Renter may not continue driving if the temperature gauge rises above the halfway mark.
All new dents and scratches on the Rental Car are for the Renter's account.
The Renter must use the supplied steering-wheel lock at all times. Theft of the car is at the Renter's own risk.
The Rental Car must be returned to the Lessor by 18:00 on the last rental day. A €50 fine is charged for late return.
The Renter must return the Rental Car clean on the last rental day as described in the contract.
If white salt stains are found in the upholstery when the car is returned, €50 per seat will be charged.
Any dispute concerning the validity, interpretation, performance or termination of the rental agreement will be settled exclusively by the competent court in Willemstad, Curaçao.
